A Gainesville man is accused of attempted rape and aggravated sexual battery at a Gainesville apartment, police said.
Ricardo Rivas, 26, was arrested Sunday and booked in to the Hall County Jail, where he remains.
Sgt. Kevin Holbrook said a group of people were at the victim’s residence on Saturday, July 28, in Gainesville.
According to the warrant, Rivas allegedly attempted to force himself on the 23-year-old victim but “was unsuccessful due to the struggle that ensued.”
“I believe she started yelling at him, because there were other people in the apartment,” Holbrook said.
Holbrook said Rivas then reportedly left the apartment and got into his car.
Police responded to the apartment Sunday, July 29. Holbrook said the victim and Rivas were previously acquainted.
Rivas’ attorney did not return a request for comment.
