An investigator told the court Friday of an alleged sexual assault from May in Hall County.
Michael Wilmont, 35, was charged with rape and aggravated sexual battery by the Hall County Sheriff’s Office. He appeared Friday with attorney David Hoffer in Magistrate Court.
Sheriff’s Office investigator Jerry Phillips said he responded to Northeast Georgia Medical Center regarding a May 15 report.
The victim told police she was in her own bedroom when the sexual assault allegedly occurred.
“When she woke up, Mr. Wilmont was on top of her,” Phillips said.
The victim reportedly told the man to stop multiple times, according to the investigator. Phillips said the woman and Wilmont were acquainted but did not have a prior romantic involvement.
Phillips said he scheduled a time to meet with Wilmont, where he said he mistakenly was in her room for about five minutes.
Hospital staff administered a sexual assault nurse examiner assessment for the woman, which has been sent to the Georgia Bureau of Investigation. The results of the exam were not available, Phillips said.
The judge moved the case on to Superior Court.
