Man faces 25 years in sodomy case

A Gainesville man was found guilty Wednesday on a charge of aggravated sodomy.


After a three-day trial that began Monday, a jury in Superior Court Judge Jason Deal's courtroom found 28-year-old Javier Gutierrez-Pena guilty of the charge, said Hall County District Attorney Lee Darragh.


Gutierrez-Pena will be sentenced at a later date as requested by his attorney, Lee Parks. The charge calls for a minimum mandatory sentence of 25 years in prison followed by life on probation.


The jury did not convict Gutierrez-Pena on the other charges he faced, including attempted rape, burglary and aggravated sexual battery.


The prosecution was led by Hall County Assistant District Attorney Shiv Sachdeva.
