An attempt to sell stolen electronics in the parking lot of a Gainesville Waffle House turned violent Friday night, police said.

Thomas Johnson confronted Derick Trejo, 18, and a juvenile in the parking lot of the Waffle House on Pentee Drive near Athens Highway, and accused them of stealing a gaming system and various video games from his residence in East Hall, according to Gainesville Police.

“Trejo was attempting to sell some of the games and/or the gaming system when Johnson confronted Trejo,” said Kevin Holbrook, public information officer for the Gainesville Police Department.

“Trejo then went to the driver’s side of his vehicle, pulled out a handgun and racked a round in the chamber and told him to back up,” he added.

Neither Trejo nor the juvenile have been charged with burglary, but Sgt. Stephen Wilbanks of the Hall County Sheriff’s Office said property crime charges could be forthcoming.

The two suspects were charged by the Gainesville Police Department with theft by receiving, aggravated assault and party to a crime of aggravated assault.

Wilbanks said Trejo was also charged with possession of alcohol under 21 and reckless conduct.

Trejo was booked into the Hall County Jail.
