After investigators found a 4-year-old severely bruised around his cheeks and ears, the child’s mother was charged with not reporting her son’s untreated broken arm, according to authorities.
Hall County Sheriff’s Office deputies charged the child’s stepfather Wednesday, June 20, with first-degree child cruelty and aggravated battery under the Family Violence Act.
Bobby Franklin Lomax Jr., 28, of Gainesville, is accused of beating his stepson Tuesday, June 19, “on and about his face, cheeks and ears resulting in severe bruising” and cuts, according to the warrants. The boy’s leg was fractured, Lt. Scott Ware said.
“The investigation revealed that the child’s biological mother, Nikki Lomax, 28, of Hall County failed to report that Bobby Lomax had beaten the child to the extent that he, the child, had previously suffered a broken arm which had been left untreated,” Ware wrote in a news release.
Ware said neither Lomax gave the child his prescribed medication for seizures.
Bobby Lomax was booked Wednesday, June 20, in to the Hall County Jail, where he remains. His legal representation was unclear Monday afternoon, according to Hall County Magistrate Court officials.
Nikki Lomax was charged with second-degree child cruelty, and she was booked Friday, June 22, in to the Hall County Jail. She is being held on a $11,200 bond, and her attorney Dan Sammons did not return a request for comment Monday, June 25.
