Judge accepts settlement in sheriffs office release lawsuit

Superior Court Judge Kathlene Gosselin on Monday accepted the agreement reached by Hall County Sheriff Gerald Couch and a Forsyth man seeking release from the Hall County Jail.

The sheriff’s office released Paul J. Bennett on Thursday, ending the lawsuit from the man convicted of less safe boating under the influence after a 2012 boat wreck that killed Jake Prince, 9, and Griffin Prince, 13. He was also charged with homicide by vessel but not found guilty of that.

“Since all inmates are afforded equitable treatment, Bennett’s release was necessary to remain consistent with that of other similarly sentenced inmates,” the sheriff’s office said in a statement Monday afternoon. “Our hearts and prayers go out to the Prince family for their loss.”

Attempts to reach county attorney Bill Blalock for comment were unsuccessful.

Bennett filed a lawsuit in Hall County Superior Court in February claiming his good behavior days were not counted for an earlier release and that he faced unequal treatment.

The deal to settle the lawsuit came together Thursday, according to Bennett’s attorney Barry Zimmerman. Bennett was released later that night.

Zimmerman said his client agreed to not sue the sheriff’s office and the county for civil damages.

Bennett received a 30-month prison sentence for the charges of less safe boating under the influence, reckless boating and failure to render aid.The total sentence was 48 months.

The probationary remainder of Bennett’s sentence will last until mid-November 2016.
