A 5-year-old boy riding his scooter was struck by an oncoming vehicle Tuesday and later died, according to Gainesville police.

Police responded to a 911 call around 7 p.m. Tuesday at The Retreat at McEver apartment complex on McEver Road regarding a child struck by a vehicle.

The child, Josue Aguirre, had been riding his scooter in the parking lot, said Gainesville Police Cpl. Kevin Holbrook.

“The initial investigation has revealed the child darted out between vehicles and was then struck by the oncoming car,” Holbrook wrote in an email.

He was transported to Northeast Georgia Medical Center and later died. No charges have been filed, officials said.
