Man gets 5 years for violation of street gang act, affray

Elborio Andrade, one of 11 defendants in an alleged gang fight that turned deadly, has been sentenced to five years in prison.

Hall County Superior Court Judge Jason Deal also sentenced the 22-year-old Gainesville man to 10 years probation for his involvement in the June 13 fight, District Attorney Lee Darragh said.

"He was charged with two offenses - affray and violation of the street gangs act," Darragh said.

"He received 12 months (incarceration) on the affray charge and 15 years, with five to serve in incarceration for the street gang act violation. The sentences are to be run concurrently."

Additionally, Darragh said Andrade was "banished from the (Ninth Judicial Administrative District), which covers most of North Georgia." Some of the counties in the district's coverage area include Hall, Dawson, Lumpkin, Union, White, Forsyth and Gwinnett counties.

On June 13, Andrade and 10 other suspected gang members were in involved in a fight at Lenox Park Apartments, off Athens Highway in Gainesville, authorities say.

According to authorities, the 11 defendants were members of the La Onda, BOE-23 and SUR-13 street gangs. Police allege that SUR-13 gang member Juan Francisco Villanueva used a minivan to run over Daniel Adame, who died from his injuries.

Villanueva also allegedly ran over 24-year-old Fernando Acosta.

At the time of the incident, the participants were all between ages 15 and 24 and all resided in Gainesville.

Villanueva was 18 at the time and Adame was 23.

Villanueva has been charged with felony murder and aggravated assault. He, like the other defendants, remains in custody, awaiting trial.
