Hall lawsuit involving former jail inmate dismissed

A lawsuit brought against Hall County by a former jail inmate has been dismissed.

Andronico Pedraza, Jr. filed the suit Dec. 23 against the county regarding an incident back in Dec. 30, 2012. Former Deputy David Pirkle pleaded guilty to simple battery in August 2013 for striking Pedraza in the back of the head while handcuffed.

Pirkle was sentenced to 12 months probation and a $675 fine.

Hall County filed a motion to dismiss on Jan. 20 for failure to state a claim.

Pedraza claimed in his complaint that Hall County “had a history of similar violence” and referenced other incidents involving Hall County Jail inmates.

“Random acts or isolated incidents are not sufficient … This does not establish a widespread practice of abuse such that the conduct of another deputy would create county liability,” according to the dismissal order by United States District Judge Richard W. Story on Tuesday.
