Man given one-year sentence in sexual battery case

A Gainesville man took a plea deal Tuesday, June 18 for one year in confinement on a case involving sexual battery against a child under 16, according to court documents.

Richard Tony Hewell, 54, took the Alford plea for two counts of sexual battery against a child under 16 before Superior Court Judge Jason Deal. The total sentence was 10 years with the first year in confinement. After that, the rest may be served on probation.

In an Alford plea, Hewell maintains his innocence while conceding the evidence against him would likely lead to a conviction.

The charges in the indictment alleged Hewell touched the girl’s intimate body parts in June 2018.

A charge of aggravated sexual battery was dismissed.

Defense attorney Clint Teston did not return a request for comment.

Hewell will receive credit for time served since July 1, 2018.

According to the sentence, Hewell will be subject to random drug and alcohol screens and the sex offender special conditions of probation.
