Jury to hear 2014 West Avenue fatal shooting case starting Wednesday

A Gainesville man will have his case tried starting Wednesday before a Hall County jury regarding a 21-year-old’s 2014 death on West Avenue in Gainesville.

Hector Alejandro Bautista, was charged with malice murder, felony murder and aggravated assault in July by a grand jury. David Olivas, of Doraville, was also charged in the indictment, but he has not been captured.

Daniel Cornejo of Gainesville was found Nov. 19, 2014, by Gainesville Police with a gunshot wound.

Cornejo succumbed to his injuries at Northeast Georgia Medical Center.

Bautista was wanted on a felony murder warrant and was extradited in June from Mexico, according to police.

At Bautista’s committal hearing, defense attorney Dan Sammons argued there was insufficient evidence to show his client had advanced knowledge or involvement in Cornejo’s death.

Court officials said the jury was selected after 4 p.m. Tuesday, and opening statements will start at 9 a.m. Wednesday.
