The Georgia State Patrol said Wednesday that no charges will be filed against the mother of a toddler who was hit Tuesday by a truck she was operating.

The 2-year-old child, JD Waggoner, was flown Tuesday evening to an Atlanta hospital, suffering from a broken leg, said Operator Baker at the Gainesville Post of the state patrol.

Waggoner’s mother, Rebecca Waggoner, was reportedly backing out of the driveway before the accident occurred, Georgia State Patrol Operator Stamey.

The child, who had followed the truck in a toy vehicle, was hit when the truck pulled forward, according to Baker.

Hall County Fire Chief David Kimbrell said the accident occurred at about 6 p.m. Tuesday near West Hall High School. Emergency officials stopped a soccer game to allow a helicopter to land and take the boy to an Atlanta pediatric hospital, Kimbrell said.

The child was flown to Children’s Healthcare of Atlanta at Egleston following the incident.

The state patrol could not say Wednesday whether the child remained in the hospital, but said that his injuries were limited to a broken leg.
