Police: Buford man shot by officers first pointed gun

Several baggies of marijuana found in 20-year-old's pockets

A man shot and killed by Gwinnett officers on Tuesday night in Buford was identified Wednesday as Jose Antonio
Hernandez-Gonzalez, 20, of Buford.

Cpl. Jake Smith, Gwinnett County Police Department public information officer, said Hernandez-Gonzalez pointed a gun at the officers before three of them fired, killing him.

Hernandez-Gonzalez was part of a group reported to be smoking marijuana at 92 N. Alexander St., Smith said.

Officers found five people in the parking lot of a small apartment complex called Alexander North and were frisking and identifying them when Hernandez-Gonzalez pulled away from the officer frisking him, Smith said.

Hernandez-Gonzalez pulled a handgun out of his clothing and held it to his own head, Smith said, and the man and officers talked for about six minutes.

Officers ordered him to drop the gun, and the man refused, saying police would have to shoot him, Smith said. When he refused, the first responding officer fired a Taser, Smith said.

The shot from the Taser did not make full contact and thus did not incapacitate Hernandez-Gonzalez, who was able to pull out the probes, according to Smith.

Immediately after pulling out the probes, Smith said Hernandez-Gonzalez pointed his gun at the officers. Three officers fired, killing him. Another officer also fired.

No officers or bystanders were hurt. Hernandez-Gonzalez had a fully loaded .357-caliber revolver during the incident and a fully loaded .45-caliber semi-automatic handgun was found at his feet. Several small baggies of marijuana were found in his pockets.

The Deadly Force Investigation Team is investigating. DFIT consists of members of the Homicide Unit, the Crime Scene Unit, Internal Affairs, the District Attorney’s Office and the Medical Examiner’s Office.

The officers involved will be placed on administrative leave. This is normal procedure in an officer-involved shooting.
