Flowery Branch restaurant brawl leads to 4 arrests

POSTED: May 24, 2012 12:36 a.m.

A Saturday night brawl at a local restaurant resulted in four arrests, including the owner and manager.

According to the Hall County Sheriff’s Office, the fight began about 9:30 p.m. Saturday at Fish Tales Lakeside Grill in Flowery Branch when Stacy Rogers-Ritenour was asked to leave by the restaurant’s owner, William Dale Ozaki.

The arrest report did not indicate the reason she was asked to leave, but Ozaki said those at the table were intoxicated and rowdy. The table included four adults and four children.

“This particular table was overintoxicated and kind of an unruly group,” Ozaki said.

Ozaki said being a restaurant on the lake, he’s seen plenty of people come in who have had too much to drink, and it is his policy not to serve alcohol to those people.

He said he and other managers made several attempts to remind the group that they were in a family restaurant and to settle down and speak at a more appropriate level.

Rogers-Ritenour could not be reached for comment.

Ozaki said the altercation started after he refused to serve Rogers-Ritenour and she attempted to bring an outside alcoholic beverage into the restaurant.

“The wife wasn’t playing by our rules or the rules of the county, and it kind of stemmed and escalated from there,” Ozaki said.

The two started arguing and the report indicates Ozaki forcefully snatched a drink from Rogers-Ritenour’s hand, which caused her to fall. This resulted in a simple battery charge for Ozaki. He was released on $5,500 bond.

Ozaki’s account differs. He said the wife waved the wine glass at him and he grabbed it by the stem and put in on a nearby table. He said he never made physical contact with the woman.

The sheriff’s office said there are conflicting stories from all parties involved and witnesses, but it was clear that at some point Rogers-Ritenour’s husband, Brian S. Rogers, and the restaurant manager, Derek Michael Weatherly, intervened and a fight ensued.

Ozaki said Rogers punched him in the jaw and Weatherly acted in his defense by hitting Rogers back.

Ozaki called the incident a tough situation that unfortunately got out of hand.

Each of the three men were charged with affray. Both Weatherly and Rogers were released on $500 bond.

Meanwhile, Rogers’ daughter, Lauren Marie Rogers, was also released on $500 bond for underage consumption of alcohol. She was not involved in the fight.

Ozaki said his staff did not serve the girl any alcohol.
