Flowery Branch: Adult businesses to get new rules

Flowery Branch City Council will convene this morning to discuss a new adult business ordinance and update the existing unsafe structure and nuisance ordinance.

The council will hear the second reading of a proposed adult business ordinance and will determine whether the new ordinance is sufficient to allow the old ordinance to be repealed and replaced.

Flowery Branch Planning Director James Riker said the adult business ordinance is simply being modernized, since it was written in the early 1990s.

The new adult business ordinance specifies the type of person able to own an adult business. Further, the proposed ordinance determines the location, capacity and prohibited uses of adult businesses, including adult motion picture arcades, adult hotels, adult video stores and adult entertainment establishments.

The proposed adult business ordinance maintains that no adult entertainment establishment may operate within any zoning category other than manufacturing and industrial. In addition, the ordinance maintains that adult businesses may not operate between midnight and 8 a.m. and are prohibited from serving alcoholic beverages.

The new ordinance also prohibits adult businesses from being located within 1,000 feet of any place of worship, school building, college campus, religious institution or any governmental building including public parks, hospitals, libraries or children’s day care centers. Also, the ordinance prohibits an adult business from being located within 1,000 feet from another adult entertainment establishment.

According to Riker, the city will alter its unsafe structure and nuisance ordinance to set new minimum standards to follow the international property maintenance code. The ordinance will establish standards for the city’s level of tolerance regarding weeds, trash, debris and unsafe structures.
