Badge & Bar: Hall County judge to rule in August on deputies’ case

POSTED: July 10, 2014 1:13 a.m.

A Hall County judge has set an Aug. 12 court date to rule on a civil case in Superior Court involving two former deputies.

Sheriff Gerald Couch filed a lawsuit naming the Hall County Civil Service Board and former deputies Jack Dodd and Larry Henslee after the quasi-judicial board voted to reinstate the two men, who were terminated in the wake of an inmate escape.

According to Sheriff Gerald Couch, the deputies in charge of a transport detail from the courthouse failed to notice James Edward Cantrell’s escape.

Couch said the deputies allowed the escape by not following protocol, and subsequently failed to report the error as soon as it was noticed, allowing Cantrell more time to get away.

Cantrell slipped out of line and hid himself in the alcove of an exterior doorway, while the deputies were loading other inmates onto a bus. He found a work truck with the keys in it and fled the area, and was captured by the Marshal’s Service days later.

Dodd and Henslee have said they were obligated to breach policy, short of proper manpower, which the office failed to remedy.

A motion filed in December said the board violated the Georgia Open Records act because the vote was taken secretly, and asked that the vote be voided.
